Terms of Service

Please read these Terms of Service ("Terms") carefully before using the ReSpeak mobile application, clinician dashboard, or website (collectively, the "Service") operated by ReSpeak Therapy ("we", "us", "our"). By creating an account or using any part of the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Who may use the Service

You must be at least 13 years old to create an account. Users under 18 must have the consent of a parent or legal guardian. By using the Service you represent that you meet these requirements.

ReSpeak offers two account types: Clinician accounts for licensed speech-language pathologists and other qualified healthcare providers, and Patient accounts for individuals completing speech therapy exercises. Each account type has different features and responsibilities described below.

2. Accounts and registration

  • You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
  • You agree to provide accurate, current, and complete information during registration and to keep it up to date.
  • You may not share your account with another person or create accounts on behalf of others without their explicit consent.
  • If you suspect unauthorized access to your account, notify us immediately at support@respeaktherapy.com.

3. Clinician responsibilities

Clinicians using ReSpeak to manage patients agree that:

  • You are a licensed or otherwise qualified healthcare professional authorized to provide speech-language pathology services in your jurisdiction.
  • You are solely responsible for the clinical decisions made using information from the Service. ReSpeak provides tools to support, not replace, your clinical judgment.
  • You have obtained appropriate consent from each patient before linking their account and accessing their data through the clinician dashboard.
  • You will use patient data only for the purpose of delivering care to that patient and in compliance with applicable law.

4. Acceptable use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable regulations, including those governing patient privacy.
  • Attempt to gain unauthorized access to other accounts, servers, or network systems connected to the Service.
  • Reverse engineer, decompile, or otherwise attempt to extract the source code of the Service.
  • Upload malicious code, viruses, or any content that could damage the Service or other users.
  • Resell or sublicense access to the Service without our written consent.

5. Health information disclaimer

ReSpeak is not a medical device and does not provide medical advice, diagnosis, or treatment. The exercises, feedback, and data provided through the Service are intended to support speech therapy practice and are not a substitute for the professional judgment of a licensed clinician.

If you are experiencing a medical emergency, call 911 or your local emergency number immediately. Do not rely on ReSpeak for urgent health decisions.

6. Subscriptions and billing

Some features of the Service require a paid subscription.

  • Subscriptions are billed on a recurring basis (monthly or annually) as selected at sign-up. You authorize us to charge your payment method on each renewal date.
  • You may cancel your subscription at any time through your account settings or by contacting us. Cancellation takes effect at the end of the current billing period. We do not issue prorated refunds for unused time.
  • We may change subscription prices with 30 days' advance notice. Continued use after the effective date constitutes acceptance of the new price.
  • Free trials, if offered, convert automatically to paid subscriptions at the end of the trial period unless cancelled beforehand.

7. Your content

You retain ownership of all content you submit to the Service, including audio recordings and session notes. By uploading content, you grant ReSpeak Therapy a limited, non-exclusive license to store, process, and display that content solely for the purpose of operating the Service and providing it to you and your authorized clinician or patient.

We will never use your recordings or therapy data to train AI models or for advertising purposes without your explicit, separate consent.

8. Intellectual property

The Service, including its design, software, exercise content, and all associated materials, is owned by ReSpeak Therapy and protected by copyright, trademark, and other intellectual property laws. Nothing in these Terms transfers any ownership of our intellectual property to you. You may use the Service solely for its intended purpose as described here.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy or completeness of any content within the Service.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RESPEAK THERAPY AND ITS OFFICERS, EMPLOYEES, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

11. Termination

You may delete your account at any time through the app settings. We may suspend or terminate your account if you violate these Terms, with or without notice, at our sole discretion.

Upon termination, your right to use the Service ends immediately. We will retain your data as described in our Privacy Policy, or delete it upon your request.

12. Governing law

These Terms are governed by the laws of the State of New York, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service will be resolved exclusively in the state or federal courts located in New York County, New York, and you consent to personal jurisdiction in those courts.

13. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or through a notice in the app at least 14 days before the changes take effect. Continued use of the Service after the effective date means you accept the updated Terms.
